Kathy Maus spoke at the 2016 Southeast Regional Claims Conference in Atlanta on September 28th, on the topic of “Issues Arising from the Duty to Defend”.

What are the most frequent issues in defending insureds in third-party claims? This program covered those, including the “eight corners rule” and it’s exceptions, defending under a reservation of rights, withdrawal from the defense, the insurer’s rights/obligations concerning declaratory relief, retention of independent counsel’ trigger theories and overlapping coverage, refusal of defense by the insured, and waiver and coverage by estoppel.
