Scott J. Frank is a Partner in the Tampa office of Butler. He focuses on the recovery and defense of arson, fraud, Chinese drywall, and coverage claims. Scott’s practice is centered on litigation, specifically in the state and federal courts. He handles a variety of issues, such as construction actions, product liability losses, and business disputes. Scott also works in our class action department and has experience in both subrogation claims and defense.
Scott is a Florida Board Certified Civil Trial attorney and earned his law degree from the University of Miami in 1988. He worked diligently gaining 6 years of experience before ultimately joining Butler in 1994. Scott’s work takes him throughout the state of Florida, as well as many neighboring locations, including Georgia, Louisiana, Puerto Rico, Virginia, New Jersey, Kentucky, and the Caribbean.

The involvement of legal counsel to provide advice concerning the settlement of property and liability claims has become increasingly commonplace. This is primarily due to the general proliferation of litigation and specifically "bad-faith" claims. As the involvement of legal counsel becomes more prevalent, so does the "defense" of "advice of counsel." This commentary will address this so-called "defense" in the context of "bad-faith" cases.
